Terms of Service

1. Who we are

VeldWatch is a product of VELDWATCH (PTY) LTD, a company registered in the Republic of South Africa (registration number 2026/409852/07) (“VeldWatch”, “we”, “us”). By creating an account or using the service, you (“the User”, “you”) agree to these Terms of Service. A contact address is available on request via support@veldwatch.com.

2. What VeldWatch is

VeldWatch is a software tool that logs, classifies, and displays operational messages received via WhatsApp from agricultural operations. It is an operational record-keeping and visibility tool for South African agricultural operations of all types - including but not limited to game farms, cattle operations, dairies, feedlots, nurseries, seed breeding programs, vineyards, and crop farms.

VeldWatch is not a security service, monitoring service, or emergency response service. We do not dispatch responders, guarantee message delivery, or provide any form of physical security. The service is provided to help you organise and review information reported by your staff; any decisions about security or emergency response remain entirely your responsibility.

3. Your account

You must provide accurate information when signing up and keep your login credentials secure. You are responsible for all activity that occurs under your account. You must be at least 18 years old to register.

4. Consent from staff

Before adding any staff member as a reporter in VeldWatch, you must ensure they are informed that their messages, voice notes, photos, phone number, and associated metadata will be captured, classified, and stored by the service for operational record-keeping purposes. You are responsible for ensuring this is communicated clearly and in line with the Protection of Personal Information Act (POPIA). VeldWatch assists this by requiring each staff member to actively reply YES from their own phone before their messages are recorded - this reply constitutes their active, phone-verified acknowledgement.

In terms of POPIA, you (the account holder) are the responsible party (data controller) in respect of your staff's personal information. VeldWatch acts as an operator (data processor) on your behalf. You are responsible for ensuring your staff are informed that their operational messages, voice notes, and photos will be captured and stored through VeldWatch.

5. Your data

You own the operational records and incident data you submit to VeldWatch. We process your data only to deliver the service as described in our Privacy Policy. We do not use your operational data for any purpose unrelated to delivering VeldWatch to you.

6. Intellectual property

VeldWatch and its content, features, and functionality - including the VeldWatch™ name, logo, codebase, and all written materials - are owned by VELDWATCH (PTY) LTD and are protected by South African and international copyright and intellectual property law. The VeldWatch name and logo may not be used without our prior written consent. Nothing in these Terms transfers any intellectual property rights to you.

7. Acceptable use

You agree not to use VeldWatch to:

• Violate any law or the rights of any person
• Process personal information without lawful basis
• Attempt to access data belonging to other users
• Interfere with, reverse-engineer, or disrupt the service
• Use the service to harass, stalk, or surveil individuals

8. Refunds and cancellations

Free trial

New subscribers receive a 14-day free trial. No charge is made during the trial period. Cancelling before the trial ends incurs no cost.

Cancellations

You may cancel your VeldWatch subscription at any time from Settings → Billing in your dashboard. On cancellation, your access continues until the end of your current billing period. No partial refunds are issued for unused days within a billing period. To cancel, sign in at veldwatch.com and navigate to Settings → Billing → Cancel subscription, or contact support@veldwatch.com.

Refunds

If you were charged in error, contact support@veldwatch.com within 30 days of the charge. We will review the request and, where appropriate, issue a full refund via the original payment method. Refunds are processed within 5–10 business days.

We do not offer refunds for change of mind after the billing date has passed, except where required by the South African Consumer Protection Act or other applicable South African law.

9. Fees and billing

VeldWatch Operations is priced at R799 per month, inclusive of all current features. New subscribers receive a 14-day free trial - no charge is made until the trial period ends. Subscriptions renew automatically on a monthly basis until cancelled. Payments are processed securely by PayFast in South African Rand (ZAR).

Design-partner accounts are offered at no charge at our discretion. Pricing for any future tiers will be communicated with at least 30 days’ written notice before taking effect.

10. Service availability

We make reasonable efforts to keep VeldWatch available, but we do not guarantee uninterrupted access. The service relies on third-party infrastructure (including hosting providers, database providers, and WhatsApp’s messaging infrastructure) whose availability is outside our control. Message delivery, in particular, depends on WhatsApp and mobile networks and cannot be guaranteed by VeldWatch.

11. Limitation of liability

To the fullest extent permitted by law, VeldWatch’s total liability to you for any claim arising out of or relating to the service is limited to the fees you paid to us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of livestock, loss of property, loss of crops, or loss of business.

Nothing in these Terms limits liability that cannot lawfully be limited under South African law.

12. Termination

You may cancel your account at any time by contacting support@veldwatch.com. We may suspend or terminate your account if you breach these Terms or if we reasonably believe you are misusing the service. On termination, your data will be handled as described in our Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above and notify active users by email. Your continued use of the service after an update constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising under these Terms will be subject to the non-exclusive jurisdiction of the South African courts.
